Should I push back with NSTL?

I just had a game fail TBT, with two issues - one regarding suspend/resume - our game timer increments by ONE SECOND during suspend/resume, and they claim "Game does not pause on Suspend/Resume" - I'm definitely fighting that.

The other issue, on the other hand, is sound-based. On the A530 and the A610, the issue is "Error #1: If the user starts the application while the handset sound setting is OFF and the application sound setting is ON, the application sound can still be heard. (Test Case 3.2.1.1)"

We've tested this on the A530, and the A610, and every single game (including some of ours that have passed, and several other games) we've tried behaves exactly the same - audio no matter what. Shouldn't this be a known issue?

Should I fight these issues? What sort of experiences have other people had with issues such as these?
